Terms of Service

1. Agreement

These Terms of Service (the "Terms") govern your access to and use of the Flosq platform, marketing site, and related services (collectively, "Flosq" or the "Service") operated by Flosq, a sole proprietorship registered in California ("Flosq," "we," "our"). By signing a written or electronic order form, by clicking "I agree," or by using the Service, you agree to these Terms.

2. The Service

Flosq provides a managed local-search visibility platform for small businesses, with an initial focus on single-location dental practices. The Service generates drafts of Google Business posts, review replies, schema markup, Q&A answers, and other marketing content. Flosq also produces audits, dashboards, and monthly reports summarizing the visibility of your business across search engines and AI-search surfaces.

3. The human-approval commitment

Flosq does not publish content under your name without your explicit human approval. Every Google Business post, review reply, Q&A answer, schema deploy, blog post, or other published artifact requires a click-through approval from you or a person you have authorized in writing. This commitment is a product invariant — it cannot be disabled by configuration, and it survives any future feature changes.

Flosq also commits to the following operational standards, regardless of customer instruction:

• →We will not solicit reviews in ways that violate Google's published Business Profile review policies, including employee-name targeting and review gating.
• →We will not bulk-generate location pages, doorway pages, or other patterns prohibited by Google's spam policies.
• →We will not generate or publish content designed to mislead search engines or your patients.
• →We will not automate posting on Reddit, Quora, Nextdoor, or any other platform whose terms prohibit such automation. Flosq surfaces opportunities on these platforms; humans decide whether to act.

4. Acceptable use

You agree not to use Flosq to:

• →Publish content that is false, misleading, defamatory, discriminatory, or otherwise unlawful.
• →Violate the terms of service of any third-party platform connected through Flosq.
• →Process Protected Health Information (PHI) or other regulated patient data. Flosq is not a HIPAA business associate and the Service is not configured for PHI.
• →Resell or repackage the Service without a written agency agreement with Flosq.
• →Reverse engineer, scrape, or attempt to derive the source code of any part of the Service.

5. Your account

You are responsible for maintaining the confidentiality of your Flosq account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to keep that information current. You must promptly notify us of any unauthorized use of your account.

6. Your content

You retain all rights to the content you upload to Flosq and to the content Flosq drafts on your behalf. You grant Flosq a non-exclusive, worldwide, royalty-free license to host, process, and transmit your content solely as necessary to operate the Service for you. We will not use your content to train generalized AI models, and we will not sell your content.

7. Billing and renewal

• →Subscription fees are billed in advance, monthly or annually, via Stripe. Annual prepay receives one month free (ten months paid, twelve delivered).
• →Subscriptions renew automatically at the end of each term unless cancelled before the renewal date.
• →Fees are non-refundable except as required by law or as stated in our pilot guarantee (clause 8).
• →Flosq may revise prices with thirty days' notice; existing subscriptions are honored at the prior price through the end of the current term.
• →Taxes are your responsibility unless Flosq is legally required to collect them.

8. Pilot guarantee

For new customers, Flosq offers a sixty-day money-back guarantee on the first paid month if Flosq has not delivered all four of: the Practice Visibility Audit, a deployed schema update, at least one approved publish to Google Business Profile, and one monthly report. To invoke the guarantee, write to sunil@flosq.com within the sixty-day window.

9. Termination

You may cancel your subscription at any time from your account settings or by writing to us. Cancellation takes effect at the end of the current billing term. Flosq may suspend or terminate your access if you materially breach these Terms, with reasonable notice except where prompt action is required to protect the Service or another party. Upon termination, Flosq will provide an export of your data on request and will delete it from active systems within thirty days.

10. Disclaimer of warranties

The Service is provided "as is" and "as available." Flosq does not guarantee any particular ranking, citation, traffic, or conversion outcome. Search engines and AI surfaces change their algorithms without notice; Flosq cannot warrant the behavior of third-party systems. Except as expressly stated, Flosq disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Flosq's aggregate liability under these Terms is limited to the amount you paid Flosq in the twelve months preceding the event giving rise to the claim. Flosq is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or lost goodwill.

12. Indemnification

You agree to indemnify and hold Flosq harmless from any third- party claim arising from your content, your use of the Service, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in San Mateo County, California.

14. Changes to these Terms

We may update these Terms as Flosq evolves. Material changes will be announced by email to active customers at least fourteen days before they take effect. Continued use of the Service after a change constitutes acceptance.
